For "corruption and fraud," Neymar faces a 5-year prison sentence.






Brazilian investment firm DIS has asked Neymar to be imprisoned for five years, ahead of his trial next week on fraud and corruption charges related to his transfer to Barcelona from Santos in 2013.








Case specifics


  •  In the case, accusations were leveled not only against former Santos manager Odilio Rodriguez, Sandro Rosell, and Josep Maria Bartomeu, but also against his mother, father, and a family-owned business.
  •  The Brazilian investment group DIS, which held a portion of Neymar's transfer rights, filed a complaint alleging that it was underpaid when Neymar joined Barcelona. This complaint gave rise to the current legal dispute.
  • Both Brazil and Spain both looked into the possibility of any transfer fee components being withheld.
  • Neymar denied any wrongdoing, but the Spanish Supreme Court dismissed the player's appeal together with that of his parents, the family business, and the two clubs in 2017, allowing for the trial.











Reuters was informed by the law firm Baker McKenzie that it would claim that Spanish courts "without authority to punish Neymar's family, given the transfer arrangement concerns a player and nationals from Brazil." Baker McKenzie will defend Neymar and his family at trial.


Rosell has previously maintained his innocence and his attorneys did not respond to a request for comment from Reuters.


Santos did not immediately react to a request for comment, Barcelona and Bartomeu's defense team declined to comment on the issue, and Rodriguez could not be located right away.


The Brazilian corporation also wanted 149 million euros ($144 million) in fines and prison terms for Rosell and Bartomeu.

















Neymar is to serve two years in prison and pay a fine of 10 million euros, Rosell is to serve five years, and the Spanish club is to pay a fine of 8.4 million euros.


Neymar must physically be in court on Monday, the opening day of the trial, according to the Barcelona court where the hearing will take place; however, it is unclear at this time if he will be required to remain throughout the trial sessions, which could last two weeks.
